How do I know if I’m eligible for workers’ comp in Concord?

In Concord and throughout North Carolina, most workers are eligible for workers’ compensation benefits if they suffer an injury or occupational illness related to their job. This includes full-time, part-time, seasonal, and even undocumented workers.

The key factor is that the injury or illness must be work-related.

Most North Carolina businesses with 3 or more employees are generally required to carry workers’ compensation insurance. However, some types of workers and employers are exempt from these requirements.

Independent contractors, though some may be misclassified and actually qualify as employees
Agricultural workers employed by farms with fewer than 10 full-time, non-seasonal employees
Domestic workers, such as housekeepers or nannies directly employed by a household
Certain sawmill and logging workers
Railroad employees, who are covered under federal law instead

How much does workman’s comp pay in North Carolina?

Workers’ comp provides a number of different benefits to aid in a worker’s recovery and ease their financial burden while they’re unable to work after an on-the-job injury.

These benefits may include:

Wage loss benefits. Employees who need to take time off to recover can expect two-thirds of their average weekly wage, up to a maximum rate that changes regularly based on inflation. This amount is not taxed, so it’s often close to the worker’s take-home pay before their injury.
Medical benefits. Qualified employees will have all necessary medical expenses and treatments covered, as well as any travel that’s further than 20 miles round-trip.
Permanent disability benefits. Workers may be entitled to long-term benefits (financial and medical) if they’re unable to heal sufficiently to return to work.
Vocational rehabilitation. If an injury or illness is so debilitating that a worker can’t return to their old job but is capable of working in another field, they may be eligible for vocational rehabilitation services.
Death benefits. If a worker dies because of a job-related accident or illness, their surviving spouse, children, or other dependents may be eligible to receive death benefits. These benefits typically include two-thirds of the worker’s average weekly wage for up to 500 weeks, along with coverage for funeral and burial costs up to $10,000.

The amount you can receive will depend on the extent of your injury, and it is negotiable, so make sure you understand the value of your claim before accepting a settlement offer.

How do I file a workers’ comp claim in Concord, North Carolina?

If your injury is severe enough, seek medical treatment immediately. Some work-related injuries occur over time from constant repetitive motion, and an emergency room visit might not be needed. But if you are in immediate distress, call 911.

The next step is to report your injury to your manager or supervisor. Starting a paper trail is key to securing your workers’ compensation benefits, so put the notification in writing. Don’t make the mistake of thinking that telling a coworker about your injury is enough. If you wait more than 30 days to report your injury to your employer, you could lose out on the ability to receive full benefits.

Proceed to get a list from your employer of approved doctors (or “panel of physicians”) that you are allowed to visit. If you balk at using the doctors or specialists on the list and proceed to use your own doctor, then your employer and their insurance company may use that as an excuse to deny your benefits.

How long do I have to file a workers’ comp claim in Concord?

The statute of limitations is the time limit (deadline) set on work injury claims, and it’s the same in both North and South Carolina. Injured employees have just 2 years from the date of the injury or diagnosis of an occupational disease to file for workers’ compensation benefits.

However, employees only have 30 days to notify their employer after an on-the-job injury or occupational disease diagnosis.
